Issue And Abolition of Emergency

Parliamentary approval

The Emergency Proclamation issued by the President is placed before each House of Parliament for approval Emergency can remain force only after approval by both Houses of Parliament.

  • Proclamation of National Emergency is required to be ratified by both Houses of Parliament within one month.
  • The 44th Amendment Act 1978 has reduced the time limit for approval by Parliament from two months to one month.
  • End of Proclamation

  • The proclamation of emergency by the President can be terminated at any time by a second proclamation. Such a proclamation does not require Parliamentary Approval.
